LOEHMANN’S INSIDER CLUB GOLD PROGRAM TERMS AND CONDITIONS

These terms and conditions (this "Agreement") govern the Loehmann’s Insider Club Gold Program (the “Insider Club Gold Program”). The Insider Club Gold Program is a program brought to you by Loehmann’s, Inc. ( "we," "us," "our," "ours"). Purchase or use of any membership in the Insider Club Gold Program ("Membership") at any time subjects the purchaser or user ("you," "your," "yours," "Member") to the provisions of this Agreement.

  1. BENEFITS. The Insider Club Gold Program entitles Members to the following benefits:
    1. Everyday discount equal to 10% off the marked Loehmann’s selling price of all eligible merchandise at any Loehmann’s store.
    2. On an annual basis, members will receive mailings that will include a total of two (2) discount cards equal to 10% off the marked Loehmann’s selling price of all eligible merchandise at any Loehmann’s store, each for one time use by Member’s friends (each card may be used one time by one friend).
    3. Loehmann’s size search service where at your request we will try to find your size in any particular item and ship it right to you free of any shipping fees.
    4. 15% birthday discount on all of your purchases any one day of your choice during your birthday calendar month.
    5. You will be the “first to know” when your favorite designers are hitting the Loehmann’s selling floor because we will notify you by mail or email.
    6. Periodic special promotions.
  2. CERTAIN CONDITIONS.
    1. For any Member's discount or other benefit to apply, the Membership account must be in effect at the time of purchase. Members will NOT be reimbursed or credited retroactively for purchases made without a Member discount at the time of purchase.
    2. Member's everyday discount is only valid on eligible purchases at any Loehmann’s store. An eligible purchase is a purchase of any merchandise except the following items: Gift Cards; shipping or handling fees; magazine subscriptions, taxes; or Membership fees (new or renewal).
    3. Member’s everyday discount may not be combined with any other Loehmann’s coupons or special offers, except where otherwise noted. However, the Member may always choose to apply another offer instead of using the Member’s everyday discount.
    4. Memberships are non-transferable.
    5. We expect Members to submit and maintain accurate and current user information in connection with their Memberships. Such information includes name, address, email address, and telephone number. Members may change their account information by:
      1. updating Member profile data through www.loehmanns.com,
      2. requesting an update from a cashier at any Loehmann’s store, or
      3. calling us at (800) 366-5634 ext. 4781.

    We are not responsible for correspondence that is lost, delayed, or misdirected.

  3. MEMBERSHIP FEE. The annual Membership fee is currently $25. We may change the Membership fee at any time, but changes will apply only to new and renewal Memberships. The fee is not refundable.
  4. TERM; RENEWAL. The initial term of a Membership shall commence on the date it is purchased and continue until one year from the last day of the calendar month in which the Membership was purchased. At the end of the initial term, the Membership is renewable for another one-year period by payment of the membership fee in effect at the time of renewal to the cashier at any Loehmann’s store. The Membership is renewable for successive one year periods by the same method.
  5. CANCELLATION; TERMINATION.
    1. You have the right to cancel your Membership at any time. If you cancel your Membership, you will not receive any refund of the membership fee.  You may cancel your Membership by calling us at (800) 366-5634 ext. 4781.
    2. We may terminate your Membership, without notice, for any reason in our sole discretion, including without limitation our belief that continued use of such Membership would violate any provision of this Agreement or applicable law. In the event of any such termination, you will be entitled to a pro rata refund of your Membership fee.
    3. We may modify or substitute any of the benefits available under the Insider Club Gold Program at any time with or without notice. In the event of our termination of this program, at our election we will either maintain your Membership benefits until expiration of your current Membership term or refund a pro rata portion of your membership fee for the remaining portion of your current Membership term.
  6. MEMBER PRIVACY POLICY. As a Member, the information we capture will be subject to the Loehmann’s Privacy Policy as amended from time to time in accordance with its terms. You may view the current version of the Loehmann’s Privacy Policy at any time online at www.loehmanns.com or you may obtain a copy of it by calling (800) 366-5634 ext. 4781. 
  7. DISCLAIMERS; LIMITATION OF LIABILITY. USE OF THE INSIDER CLUB GOLD PROGRAM AND ANY OF ITS ASSOCIATED BENEFITS IS AT YOUR SOLE RISK. THE MEMBERSHIP BENEFITS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. LOEHMANN’S, INC. AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS AND AGENTS (COLLECTIVELY "MEMBERSHIP PROVIDERS") EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. MEMBERSHIP PROVIDERS MAKE NO WARRANTY THAT :
    1. THE INSIDER CLUB GOLD PROGRAM WILL MEET YOUR REQUIREMENTS,
    2. THE INSIDER CLUB GOLD PROGRAM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR
    3. THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU FROM YOUR USE OF THE INSIDER CLUB GOLD PROGRAM WILL MEET YOUR EXPECTATIONS. MEMBERSHIP PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF MEMBERSHIP PROVIDER HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM:
      1. THE USE OR THE INABILITY TO USE THE INSIDER CLUB GOLD PROGRAM OR ANY BENEFITS THEREOF;
      2. THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED VIA THE USE THE INSIDER CLUB GOLD PROGRAM;
      3. UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR INSIDER CLUB GOLD PROGRAM DATA; OR
      4. ANY OTHER MATTER RELATING TO THE INSIDER CLUB GOLD PROGRAM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL, CONSEQUENTIAL OR OTHER DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.
  8. GOVERNING LAW. This Agreement, and the respective rights and obligations of the parties hereunder, shall be governed by, and construed in accordance with, the laws of the State of New York, without regard to conflict of law principles.
  9. BINDING ARBITRATION. Any controversy or claim arising out of or relating to this Agreement (including any breach thereof) or the Insider Club Gold Program shall be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules (including without limitation the Supplementary Procedures for Consumer-Related Disputes), and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated with any claim or controversy of any other party. The foregoing shall not preclude Loehmann’s, Inc. or any of its affiliates from seeking any injunctive relief in State or Federal courts.
  10. ACKNOWLEDGMENT. This Agreement, including all documents referenced herein, represents the entire understanding between us and any user of the Insider Club Gold Program with respect to the Insider Club Gold Program and supersedes any other agreements, statements or representations. Any user of any portion of the Insider Club Gold Program is deemed to have accepted the terms and conditions of this Agreement.
  11. CHANGES TO THIS AGREEMENT. We may change the terms of this Agreement at any time by posting a revised Agreement on the Member Program website located at www.loehmanns.com. We may also notify Members of such change in writing by regular mail or via email to the address in the Member's account. Any change shall take effect immediately, unless otherwise provided. You may view the current version of this Agreement at any time online at www.loehmanns.com or you may obtain a copy of it by calling (800) 366-5634 ext. 4781. 
  12. Only United States residents with a United States postal address may participate.
  13. EMPLOYEES OF LOEHMANN’S ARE NOT ELIGIBLE TO PARTICIPATE

LOEHMANN’S INSIDER CLUB DIAMOND PROGRAM TERMS AND CONDITIONS

These terms and conditions (this "Agreement") govern the Loehmann’s Insider Club Diamond Program (the “Insider Club Diamond Program”). The Insider Club Diamond Program is a program brought to you by Loehmann’s, Inc. ( "we," "us," "our," "ours"). Use of any membership in the Insider Club Diamond Program ("Membership") at any time subjects the user ("you," "your," "yours," "Member") to the provisions of this Agreement.

  1. BENEFITS. The Insider Club Diamond Program entitles Members to the following benefits:
    1. Everyday discount equal to 10% off the marked Loehmann’s selling price of all eligible merchandise at any Loehmann’s store.
    2. Extended return policy – return merchandise within thirty (30) days after purchase for a refund.
    3. For any purchase over $200 we will ship it to you free of any shipping fees.
    4. On an annual basis, members will receive mailings that will include a total of four (4) discount cards equal to 10% off the marked Loehmann’s selling price of all eligible merchandise at any Loehmann’s store, each for one time use by Member’s friends (each card may be used one time by one friend).
    5. Loehmann’s size search service where at your request we will try to find your size in any particular item and ship it right to you free of any shipping fees.
    6. Free gift boxes will be available to you with your purchases from November 27th through December 24th.
    7. 15% birthday discount on all of your purchases any one day of your choice during your birthday calendar month.
    8. You will be the “first to know” when your favorite designers are hitting the Loehmann’s selling floor because we will notify you by mail or email.

    3. THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU FROM YOUR USE OF THE INSIDER CLUB DIAMOND PROGRAM WILL MEET YOUR EXPECTATIONS.
